Governor Kathy Hochul has officially opened the application period for the Farm Employer Overtime Tax Credit, a refundable program designed to support New York’s agricultural workforce and reduce the financial burden on farm businesses.
Eligible farm employers can now apply for reimbursement of overtime wages paid between January 1 and July 31, 2025. The initiative is part of a broader effort to boost food production, improve affordability, and ensure fair compensation for farm workers.
Governor Hochul emphasized the importance of the program, stating:
“Our farmers and farm workers are the backbone of New York. This credit helps them thrive while continuing to deliver fresh, local products to our communities.”
Farmers who used Professional Employer Organizations (PEOs) in 2024 may also apply for overtime reimbursement from that year. Applications must be submitted to the Department of Agriculture and Markets by September 30, and approved applicants will receive a certificate of advance payment. This certificate allows them to request their share of the credit from the Department of Taxation and Finance by November 1.
The program is part of a growing suite of tax relief efforts aimed at strengthening New York’s agricultural economy and supporting rural labor.
